In most cases, a bankruptcy case begins when a debtor (or usually the debtor’s attorney) files a petition with the court, along with many different schedules, statements and other required documents. It ends when the case is closed by the judge.[/vc_toggle][vc_toggle title=”How Much Does Bankruptcy Cost?” css_animation=”none” el_id=”1489502905563-e29b0d23-e63e”]We charge $1485 (including all fees and costs) for a Chapter 7 bankruptcy. Extra fees may apply to extremely complicated cases.[/vc_toggle][vc_toggle title=”How Does Bankruptcy Help Me?” css_animation=”none” el_id=”1489502905062-f32a7618-e6e0″]Bankruptcy gives clients instant relief in the form of a thing called the “Automatic Stay”. This is a court order that goes out to all creditors after a bankruptcy filing and it makes it illegal for any creditor to make any attempt to collect on almost any typical consumer debt. Creditors can get in BIG trouble for violating the automatic stay and so such violations are very rare. During your case, creditors attempting to collect on debts cannot call clients, write them, sue them, garnish their wages or bank accounts, or foreclose or repossess any property without first getting the court’s permission.

At the end of the successful bankruptcy case, debtors receive a discharge of their debts. This means that the federal court has ruled that no creditor can ever collect on these debts again.

So, in a nutshell, a bankruptcy case means instant relief and a fresh financial start.[/vc_toggle][/vc_column_inner][vc_column_inner width=”1/3″][vc_custom_heading text=”Still Curious?” font_container=”tag:h5|font_size:22px|text_align:left” use_theme_fonts=”yes” css=”.vc_custom_1588735898809{margin-top: 30px !important;margin-bottom: 20px !important;}”][vc_column_text css=”.vc_custom_1588736065355{margin-bottom: 30px !important;}”]Declaring bankruptcy can protect you and your family from creditors. What should I do?” css_animation=”none” el_id=”1489503965078-f3a803ee-ee0e”]Stay quiet! Make no statement to anybody, especially to any law enforcement officers. Contact an attorney immediately for advice.[/vc_toggle][vc_toggle title=”What is the difference between an infraction, a misdemeanor and a felony?” css_animation=”none” el_id=”1489503965135-7fd256e5-cb3a”]An infraction is not really a criminal charge – though it is an accusation that you violated a law. Infractions usually involve allegations of violating traffic laws like speeding or running a stop sign. You can’t go to jail or prison if you are convicted of an infraction, but you can be fined and earn DMV demerit points that can result in license suspension and insurance rate increases or cancellation.

A misdemeanor is crime that can result in 12 months of jail or less and/or a fine of $2500 or less. Misdemeanors come in classes – Class 1 and Class 2 misdemeanors are punishable by jail, while Class 3 and Class 4 misdemeanors are punishable by fines. Misdemeanor convictions are recorded on your criminal record.

A felony is crime that can result in a punishment of death or one year or more of incarceration in the Department of Corrections. Most felonies come in classes, from Class 1 to Class 6, with Class 1 being the most serious felony and punishable by death and Class 6 being the least serious felony punishable by a maximum of 5 years imprisonment and/or a fine of $2500.[/vc_toggle][vc_toggle title=”Can Your Firm Handle My Case?” css_animation=”none” el_id=”1489503965197-ebede312-68b5″]Absolutely!
